KYLE HO's ("we" "us") website(s) (our "Site" or "Sites") and related services are provided to you in accordance with the following Terms of Use & Service ("TOS") and any additional guidelines or rules posted on our Sites. Please carefully review the TOS before making any purchases or using our website, www.kyleho.com. Retaining a copy of the TOS for your future reference is advisable.

In particular, we would like to draw your attention to our policies regarding the terms of purchase within the TOS and our Privacy Policy. If you are under 16, it is essential that you inform your parent or guardian about KYLE HO's Privacy Policy before registering to use this site or any of its services. Please note that we reserve the right only to accept orders from individuals over the age of 18.

We may revise the TOS periodically. We recommend that you review the TOS regularly. If you disagree with any changes to the TOS, you must cease using the site immediately. Any changes made after you have placed an order will only impact that order if we are obligated to change the policy.

Registration and Account Terms and Conditions

To access certain services and features on this site, you are required to register for an account. During registration, you must provide accurate, current, and complete information about yourself. Forgotten Password:

If you've forgotten your password, you can follow the "FORGOTTEN PASSWORD" instructions on the SIGN-IN page. For security reasons, we do not send passwords via email.

Eligibility to Purchase

To make purchases on the site, you must provide your personal information, including your real name, phone number, email address, and other requested details. Additionally, you must supply valid and accurate payment information and confirm that you are the person identified in the provided billing information.

Access to the Site is granted to individuals and others who meet KYLE HO's eligibility criteria, possess a valid credit/debit card issued by an acceptable bank, submit acceptable applications to KYLE HO, and authorise KYLE HO to charge their credit/debit card for the total purchase price of the merchandise they buy. Products acquired by the buyer are intended for personal or gift use and should not be resold or used for commercial purposes or any other commercial benefit. KYLE HO reserves the right to limit the quantity of an item shipped to a single customer or postal address.

By making a purchase offer, you explicitly allow us to conduct credit checks and, when deemed necessary by KYLE HO and to the extent allowed by applicable laws, to share or obtain information (including updated information) about you from third parties. This may include your credit/debit card number or credit reports (including reports for your spouse if you reside in a community property jurisdiction) to verify your identity, validate your credit/debit card, obtain initial credit/debit card authorisation, and approve individual purchase transactions.

In addition, you agree that we may use your personal information to perform appropriate anti-fraud checks. Your personal information may also be disclosed to a credit reference or fraud prevention agency, which may maintain a record of it.

Orders

All orders are subject to acceptance and availability. The items in your Shopping Bag are not reserved and may be purchased by other customers.

KYLE HO offers products for sale that are in stock and available for dispatch from our studio. However, there may be instances where we are awaiting shipments from our suppliers. In such cases, you may have the option to make an Advance Payment for specific items, ensuring priority access once the stock arrives at Kyleho.com. Advance Purchase orders are only accepted for stock scheduled for delivery by the supplier. Your rights regarding Advance Purchase are the same as those for any other purchase at kyleho.com. Alternatively, you can register your email address to receive notifications when selected merchandise becomes available.

Stock received into inventory may be allocated to fulfil Advance Payment orders, and customers who make Advance Payments will receive items with priority over customers on the Waiting List or those ordering for immediate delivery through the site. Please be aware that we may be unable to deliver selected Advance Payment merchandise due to production or quality issues identified upon receipt. In such cases, we will email you and refund the Advance Payment to your credit/debit card within thirty days of being informed that the merchandise is unavailable.

If you've registered your email address to receive notifications about specific products featured on our site, we will email you within 48 hours of the product becoming available. Please note that certain high-demand products may sell out during this period.

KYLE HO retains records of your transactions for a minimum of one year.

Pricing Policy

Prices displayed on the site are in GBP or Euros and include VAT at the applicable rate unless you have selected an alternative country without VAT.

All prices and offers remain valid as advertised from time to time. The price of a product in GBP or Euros displayed on the site when your order is accepted will be honoured, except in cases of patent error. Occasionally, prices may change in response to currency exchange rate fluctuations, markdowns, and other commercial factors. The price applicable to your order will be in effect when your order is accepted.

Customers purchasing from a country served as DDP (Delivery Duty Paid) will include relevant import duty and tax in the final purchase price. Customers purchasing from a country served as DDU (Delivery Duty Unpaid) will only be charged for the items and shipping costs. Import duty or tax costs will be invoiced directly to you by DHL or an appointed import broker. We recommend that you contact your local customs authority to determine the landed cost price before you complete your purchase.

For customers whose credit/debit cards are not denominated in Sterling or Euros, the final price will be calculated based on the applicable exchange rate on the day your card issuer processes the transaction.

Regardless of your shopping destination and currency, your purchase may be processed by one of our regional affiliate studios. In such cases, your bank may charge you an international transaction fee, for which KYLE HO is not responsible.

Sale Price Adjustment Policy

KYLE HO is pleased to offer a Sale Price Adjustment on items purchased up to 7 days before the start of a sale. Please note that the exact style and size of the item must be available for purchase at the time of your request before a sale price adjustment can be approved. Approved Sale Price Adjustments will be credited to your FIA STUDIO account as store credit, valid for 12 months.

Price adjustments are unavailable for items originally purchased on sale or any special promotion items temporarily discounted. Once an item has been purchased at a reduced sale price, no further price adjustments will be offered if the item is further marked down.

Acceptance of Your Order

Once you have selected and placed your order, you will receive an email confirming the details of your order. It's important to note that this email acknowledges your order receipt and is NOT an acceptance of your order.

Unless you decide to cancel your order, the contract between you and KYLE HO will be accepted and completed when we send you an email confirming the dispatch of the goods. This contract is considered concluded in London, England, and its language is English. It's worth mentioning that neither our third-party payment processor nor our designated courier has the authority to accept an order on behalf of KYLE HO.

We retain the right to decline your order for various reasons, such as the inability to obtain payment authorisation, shipping restrictions on a specific item, the item being out of stock or not meeting our quality control standards, resulting in its withdrawal, or if you do not meet the eligibility criteria outlined in the TOS.

Additionally, we reserve the discretion to refuse processing and thus acceptance of any transaction and the right to refuse service to any individual at any time at our sole discretion. We will not be held liable to you or any third party for withdrawing any merchandise from the site, regardless of whether the merchandise has been sold, or for removing, screening, or editing any materials or content on the site, refusing to process a transaction, or cancelling or suspending any transaction after processing has commenced.

While we make every effort to ensure the accuracy of details on our website, there may be occasions when we need to correct the pricing of products. Should such an error in pricing be identified in your order, we will immediately notify you. We are not obligated to accept or fulfil an order for an incorrectly priced product and reserve the right to cancel such an order that has been accepted or is in transit. If you have already made payment for the goods, we will refund the total amount as soon as possible. If the product is recalled during transit, we will process your refund once it's returned.

Payment

We accept various payment methods, including Visa, MasterCard, American Express, Maestro, JCB, PayPal, and Apple Pay, as advertised on the site. Payment will either be debited and cleared from your account when you receive your order or processed within a maximum of five days from the date of purchase, whichever happens first. You confirm that the credit/debit card used for payment belongs to you or that the card owner has duly authorised you to use it. All credit/debit card transactions are subject to validation checks and authorisation by the card issuer. If your payment card issuer declines authorisation for the payment to KYLE HO, we will not be held responsible for any delay or delivery failure.

We take reasonable precautions to ensure the security of our site. All credit/debit card transactions on our site are processed using Datacash, a secure online payment gateway that encrypts your card details in a secure host environment. If you are a registered Kyleho.com user, we securely store your credit/debit card details on our systems. These details are fully encrypted and are solely used for processing card transactions you initiated.

To enhance the safety, simplicity, and security of your shopping experience, Kyleho.com employs Secure Socket Layer (SSL) technology. While we take reasonable steps to maintain the security of your order and payment details, we cannot be held liable for any losses you may incur if a third party gains unauthorised access to your data during your use or order placement on the site.

Our Policy

To ensure a smooth returns process, please follow our policy outlined below:

  • Items must be returned unused, with all original KYLE HO garment tags still attached. We cannot accept returns of damaged or soiled items, which will be returned to the customer with a refund refusal.

  • If your purchase includes belts or any packaging, such as authenticity cards, dust bags, and leather tags, please ensure that these are included with your return.

  • If your purchases are delivered without the kyle ho tags, please get in touch with us at customercare@kyleho.com

  • It is important to request a return before sending your item(s) back to us. This allows for easy identification and swift processing of your return. Unidentified returns will be sent back to the sender.

Please adhere to these guidelines when initiating a return with KYLE HO to facilitate a smooth and efficient process.

While we strive to display the colours of our products on the Kyleho.com website as accurately as possible, please note that the colour representation may vary depending on your computer monitor or device. We cannot guarantee that the colours you see on your screen will precisely match the actual product colours.

Repeated Returns
